1. Who we are

This Privacy Policy explains how VXD INC ("MÖNKE", "we", "us", "our") collects, uses, shares and protects personal information when you visit www.wearemonke.com (the "Site"), buy our products, sign up for our emails, enter our Vinyl Love giveaway or contact us.

VXD INC is a company based in Canada. If you live in the European Union, the United Kingdom or Japan, you buy from Sons & Daughters Ltd, 71-75 Shelton Street, London WC2H 9JQ, United Kingdom, which is then the business responsible for your personal information (the "controller" under European and UK law), and "MÖNKE", "we", "us" and "our" in this policy also refer to it. For customers in all other countries, VXD INC is the business responsible for your personal information.

By using the Site, you acknowledge that you have read this policy. Where the law requires your consent (for example, for marketing emails or advertising cookies), we will ask for it separately.

2. Information we collect

Information you give us

  • Order details: name, shipping and billing address, email, phone number, the products you buy, and order notes.
  • Payment details: these are handled directly by our payment providers (such as Shopify Payments, PayPal, Apple Pay, Google Pay and Shop Pay). We never see or store your full card number.
  • Account details: if you create an account, your login email and order history.
  • Customer support: messages you send us by email, contact form or social media, and any photos you include (for example, of a damaged item or a warranty claim).
  • Email sign-ups: your email address, language, country and marketing preferences.
  • Vinyl Love giveaway entries: see section 4.
  • Affiliate applications: if you apply to our affiliate program, your name, contact details, website or social profiles, and payout details.

Information collected automatically

  • Device and usage information: IP address, browser type, device type, language, approximate location (from your IP address), pages viewed, products viewed, the site that referred you, and time spent on the Site.
  • Cookies and similar technologies: see section 5.

Information from others

  • Service providers: for example, delivery and tracking updates from shipping carriers, and fraud-check results from our payment providers.
  • Social media and advertising platforms: if you interact with our ads or pages, platforms like Meta, Pinterest, TikTok and Google may share aggregated or limited information with us, such as whether an ad led to a visit or purchase.

We do not knowingly collect sensitive personal information (such as health, religious or biometric data). Please do not send it to us.

3. How we use your information

We use personal information only for the purposes below. If you are in the EU, UK or another place that requires a "legal basis", the right-hand column shows ours.

We do not use automated decision-making that has legal or similarly significant effects on you.

4. Vinyl Love giveaway

When you enter our monthly Vinyl Love giveaway, we collect your first and last name, email address, country, order number, and the photos or videos you submit.

  • How we use it: to confirm your entry, send you a thank-you email, review submissions, choose winners as described in the giveaway terms, and contact and ship prizes to winners.
  • Where it's stored: submissions are stored in our Google Drive (Google Workspace), which acts as our service provider.
  • What we publish: approved photos may appear in the collage on our Vinyl Love page and on our social media. If you win, we may announce your first name and photo in our newsletter. We never publish your last name, email, address or order number. Videos are not shown in the collage.
  • Your choice: you can ask us at any time to remove your photo from the Site or our channels by emailing support@wearemonke.com. We will remove it from places we control within a reasonable time.
  • Retention: entries stay eligible until they win, as set out in the giveaway terms. We keep original submissions and winner records for as long as the giveaway runs and as needed for record-keeping, unless you ask us to delete them.

Please only submit photos you took yourself and that don't show other people without their permission.

5. Cookies, pixels and advertising

We and our partners use cookies, pixels and similar technologies on the Site.

Your choices

  • Cookie banner: in the EU, UK, Quebec and other places where it is required, non-essential cookies are only used after you agree. You can change your choice at any time through the cookie settings link on the Site.
  • Browser settings: you can block or delete cookies in your browser. Essential cookies are needed for checkout to work.
  • Ad settings: you can control personalised ads through your Meta, Google, Pinterest and TikTok account settings, and through industry opt-out tools such as aboutads.info and youronlinechoices.eu.
  • Global Privacy Control: we treat a Global Privacy Control signal from your browser as a request to opt out of the "sale" or "sharing" of your personal information, where the law requires it.

We do not currently respond to "Do Not Track" browser signals, because there is no common standard for them.

6. Who we share it with

We share personal information only as needed to run our business, and only with:

  • Shopify, which hosts our store, checkout and customer data. See Shopify's Privacy Policy.
  • Payment providers (such as Shopify Payments, PayPal, Apple Pay, Google Pay and Shop Pay) to process payments and prevent fraud.
  • Fulfillment, logistics and shipping providers that store our inventory, pack your order and deliver it, and the carriers that give you tracking updates.
  • Email and messaging providers (such as Klaviyo or Shopify Email) to send order, support and marketing emails.
  • Advertising and analytics partners (Meta, Pinterest, TikTok and Google), as described in section 5.
  • Google Workspace, where we store business files, including Vinyl Love submissions.
  • Professional advisers such as accountants and lawyers, under confidentiality duties.
  • Authorities, when the law requires it, or to protect our rights, our customers or others from fraud or harm.
  • A buyer or successor, if our business is sold, merged or reorganised. Your information would remain protected by this policy or one with equal protection.

We do not sell your personal information for money. However, some US state laws (including California's) treat letting advertising partners collect data through pixels for targeted ads as "selling" or "sharing". You can opt out of this at any time, as described in section 9.

7. International transfers

We are based in Canada and the United Kingdom and sell to customers in many countries. Our products are stored and shipped from fulfillment centres within the regions we sell to, so your shipping details go to the fulfillment provider serving your country or region. Our service providers store and process data in several countries, mainly Canada, the United States and the European Union. Your information may therefore be handled outside the country where you live, and the laws there may differ from yours.

When we transfer personal information out of the EU, UK or Switzerland, we rely on adequacy decisions (the EU and UK recognise Canada as providing adequate protection for commercial data) or on safeguards such as the European Commission's Standard Contractual Clauses and the UK International Data Transfer Addendum, which our main providers (including Shopify and Google) include in their terms.

For customers in Australia and Japan: by placing an order or using the Site, your information will be disclosed to us in Canada or the United Kingdom and to the providers listed in section 6, which are mainly in Canada, the US and the EU. We take reasonable steps to make sure these recipients protect it in line with this policy. Each of these countries has its own privacy laws, and you can ask us for more information about how your data is protected there.

8. How long we keep it and how we protect it

We keep personal information only as long as we need it for the purposes in this policy:

  • Orders and transactions: for as long as tax and accounting laws require, generally up to 7 years after the purchase.
  • Customer accounts: until you ask us to close the account, then as needed for order records.
  • Marketing email lists: until you unsubscribe. We then keep only a record of the unsubscribe so we don't email you again.
  • Support messages: up to 3 years after the issue is resolved, or longer if needed for a warranty claim.
  • Vinyl Love entries: as set out in section 4.
  • Cookies: for the periods shown in your browser or our cookie settings, typically from the end of your visit up to 2 years.

When we no longer need it, we delete the information or make it anonymous.

Security: we use reputable providers with strong security (Shopify is PCI DSS compliant), encrypted (HTTPS) connections, access limited to staff who need it, and two-factor authentication on our business accounts. No system is completely secure. If a breach creates a real risk of significant harm to you, we will notify you and the authorities as the law requires.

9. Your rights and choices

Wherever you live, you can ask us to:

  • tell you what personal information we hold about you and give you a copy;
  • correct information that is wrong or incomplete;
  • delete your information, unless we must keep it (for example, for tax records);
  • stop sending you marketing emails (use the unsubscribe link in any email, or contact us).

To make a request, email support@wearemonke.com with the subject "Privacy request". We may need to confirm your identity (for example, by asking you to reply from the email used for your order). We will respond within the time the law allows, usually within 30 days. Requests are free, and we will never treat you differently for using your rights. You can also authorise someone to make a request for you, with proof of their authority.

European Union, European Economic Area, UK and Switzerland

Under the GDPR and UK GDPR you also have the right to restrict or object to our processing (including direct marketing and processing based on legitimate interests), to data portability, and to withdraw your consent at any time without affecting earlier processing. You can complain to your local data protection authority, for example the UK Information Commissioner's Office or the authority in your EU country. We'd appreciate the chance to resolve your concern first.

Canada (including Quebec)

Under PIPEDA and provincial laws, you may access and correct your information and withdraw consent, subject to legal or contractual limits. Quebec residents also have the right to data portability and to be told about automated decisions. Our Privacy Officer is responsible for protecting personal information. If you are not satisfied with our response, you can contact the Office of the Privacy Commissioner of Canada or, in Quebec, the Commission d'accès à l'information.

United States

Residents of California and other states with privacy laws (such as Colorado, Connecticut, Virginia, Texas, Oregon and others) have the right to know, access, correct and delete their information, to opt out of the "sale" or "sharing" of personal information and of targeted advertising, and to appeal a decision about their request by replying to our response.

  • Categories collected in the last 12 months: identifiers (name, email, address, IP address); commercial information (purchase history); internet activity (browsing on the Site, ad interactions); approximate geolocation; and photos or videos you send us. Sources and purposes are described in sections 2 and 3.
  • "Sale" and "sharing": we do not sell personal information for money. We do allow advertising partners (Meta, Pinterest, TikTok and Google) to collect identifiers and internet activity through pixels for targeted advertising, which may count as "selling" or "sharing". To opt out, use the "Your Privacy Choices" link in our footer or turn on Global Privacy Control in your browser.
  • Sensitive information: we do not collect it.
  • Minors: we do not knowingly sell or share the personal information of anyone under 16.

Australia

We handle personal information in line with the Australian Privacy Principles where they apply. You may access and correct your information and make a complaint to us. If you are not satisfied with our response, you can contact the Office of the Australian Information Commissioner.

Japan

We handle personal information in line with Japan's Act on the Protection of Personal Information (APPI). You may ask us to disclose, correct, stop using or delete your information, and to stop providing it to third parties, as allowed by the APPI. Information about the foreign countries your data is transferred to is in section 7.

10. Children, changes and contact

Children: the Site is not directed at children, and we do not knowingly collect personal information from anyone under 16. If you believe a child has given us information, contact us and we will delete it. Vinyl Love winners must be 18 or older, or the age of majority where they live.

Other sites: the Site links to social media and other sites. Their privacy practices are their own, so please read their policies.

Changes to this policy: we may update this policy from time to time. We will post the new version on this page with a new "Last updated" date. If the changes are significant, we will tell you by email or with a notice on the Site.
